NYS Marriage Certificate vs. NYC Records: Where to Apply?
A New York State marriage certificate covers all marriages outside the five New York City boroughs.
Marriage records in NYC (Manhattan, Kings/Brooklyn, Queens, Bronx, and Richmond/Staten Island) are not maintained by the state. Instead, you must apply to the NYC Clerk’s Office.
Copies of New York State marriage certificates are issued by the New York State Department of Health, Vital Records Certification Unit. This office maintains records from 1881 to present for marriages outside New York City.
You can also get a copy from the town or city clerk where the marriage license was originally purchased. For pre-1914 records from Albany, Buffalo, or Yonkers, contact the relevant city clerk directly.
Who Can Order a Marriage Certificate in NY?
In New York State, access to certified marriage certificates is restricted. A certified copy is usually available only to certain people, including:
- Either spouse named on the marriage certificate
- Other individuals with documented judicial or other proper purpose
- Applicants with a New York State court order
All applications must include identification: either a valid photo ID or two documents showing your name and address.
Accepted IDs include a driver’s license, a state-issued nondriver ID, a passport, or a U.S. military photo ID. If you’re submitting documents instead, you need to provide utility or telephone bills or government correspondence dated within the last six months.
New York vital records are not open public records. They cannot be requested through Freedom of Information Law (FOIL) requests, so you must use the official marriage certificate request process and meet the eligibility rules.
Genealogy copies are available if the record is at least 50 years old and both spouses are deceased. Direct-line descendants can bypass the 50-year limit if they provide proof of their relationship and the death of both spouses.
