Understanding the New Alabama Marriage Certificate System

Alabama marriage certificates are available from the Alabama Department of Public Health (ADPH), Center for Health Statistics. They maintain records for marriages from August 1936 to present.

As of 2019, couples in Alabama are required to complete an Alabama marriage certificate form and submit it to a probate court for recording. A marriage is legally valid once the form is properly completed, signed, notarized, and recorded by the probate court.

Once the probate court records the form, the original certificate is sent to the ADPH Center for Health Statistics, where you can request certified copies. A wedding ceremony is not required for the marriage to be legally recognized — the recording of the form is what makes it official.

The Alabama Marriage Certificate Form: Recording vs. Ordering a Copy

A completed Alabama marriage certificate form must be submitted to the probate court within 30 days of the date of signing by both spouses**.

Electronic signatures or notaries not authorized under Alabama law are not accepted. Marriage certificate forms sent directly to the ADPH Center for Health without probate court recording will be returned unprocessed, and the marriage will not be recorded.

Once recorded, certified copies can be requested through the ADPH Center for Health Statistics.

  • If you need to record a marriage: Complete the form, have both spouses sign, and submit it to the probate court within 30 days
  • If you need a certified copy of an already recorded marriage: Request the copy from the ADPH Center for Health Statistics after the probate court has recorded the form (allow at least a few days)

Who’s Eligible to Order a Marriage Certificate in Alabama?

Alabama marriage certificates are unrestricted under state law. Anyone can request a copy if they provide sufficient information to locate the record and submit the required fee.

No proof of relationship or identity as a spouse or family member is required to order a copy of a certificate of marriage. To order a copy for unions registered from August 1936 onwards, apply to the Alabama Department of Public Health (ADPH), Center for Health Statistics.

If the marriage was recorded before August 1936, you can only request a copy of the certificate from the probate office in the county where the marriage license was originally issued.
